Why are we giving you this notice?

Financial companies choose how they share your personal information. Federal law gives consumers the right to limit some, but not all, sharing. Federal law also requires us to tell you how we collect, share and protect your personal information. This notice describes how all of the companies in the First United Corporation family share your personal information. Please read this notice carefully to understand what we do.

Definitions:

information means personally identifiable financial information about you that is not publicly available.

affiliates mean the companies in the First United Corporation family, including financial companies with a First United name and financial companies such as First United Bank & Trust, First United Insurance Group, Oakfirst Loan Center, Inc., and Oakfirst Loan Center, LLC.

What information do we collect about you?

We collect information about you from you and from other sources, including:

  • Information we receive from you on applications or other forms, such as your income
  • Information we obtain to verify representations made by you, such as your open lines of credit
  • Information about your transactions with us, our affiliates, or others; and
  • Information we receive from a consumer reporting agency.

What information do we disclose?

We may disclose all of the information we collect about our customers and former customers to nonaffiliated third parties as permitted by law, for example, to process your transactions, maintain your account, report to credit bureaus and respond to subpoenas.

Unless you tell us not to (see Do you have Choices?), we may disclose all of the information we collect about our customers and former customers to our financial service affiliates, such as insurance agents.

We may disclose all of the information we collect about our customers and former customers to companies that perform services and functions, including marketing services, on our behalf and we may disclose some of this information to other financial institutions with whom we have joint marketing agreements.

Medical information and information related to trust and fiduciary services only is shared as necessary to process your transactions and as permitted or required by law.

How do we keep information secure?

We restrict access to information about you to those employees who need to know that information to provide products or services to you. We maintain physical, electronic, and procedural safeguards that comply with federal regulations to guard your nonpublic personal information.

How may our privacy policy change?

We reserve the right to change our privacy policy and this privacy notice from time to time without prior notice to you, unless prior notice is required by law. If you have a continuing customer relationship with us, we will provide you with our current privacy notice not less than annually as required by law.

Do you have choices?

You may opt out of our sharing some information – information about your creditworthiness that doesn’t come from our transactions or experiences with you - with affiliates. If you prefer that we not share this information with our affiliates, you may direct us not to share by filling out and tearing off the bottom of this sheet and mailing it to us. If you are a new customer, we can begin sharing this information 30 days from the date we give this Privacy Notice to you. However, you can contact us at any time to limit our sharing.

Your direction in this paragraph covers certain information about you that we might otherwise share with our corporate family. Under the Fair Credit Reporting Act, we are permitted by law to share among our affiliates information concerning a customer's transactions and experiences with all of our affiliates, even if you opt out of sharing other information. An opt out by a joint consumer will be treated as applying to all holders of the account(s).

How can you help us maintain accurate information about you?

We strive to maintain accurate information about you. If you ever think that our records contain inaccurate information about you, please let us know. We’ll correct any mistakes promptly. If you think we have reported inaccurate information to a consumer reporting agency, please let us know by writing us at 19 S. Second Street, Oakland, MD 21550. Please give us your name, address, telephone number, and the information you think is wrong. We will investigate and take corrective action if the information we furnished was inaccurate.

FURNISHING NEGATIVE CREDIT INFORMATION. WE MAY REPORT INFORMATION ABOUT YOUR ACCOUNT TO CREDIT BUREAUS, LATE PAYMENTS, MISSED PAYMENTS OR OTHER DEFAULTS ON YOUR ACCOUNT MAY BE REFLECTED IN YOUR CREDIT REPORT.

According to the Federal Trade Commission, identity theft is the fastest growing crime in the country. Our ability to feel safe is becoming more difficult with terrorism and crime on a steady increase.

The USA PATRIOT Act has paved the way for financial institutions to help prevent fraud, identity theft, and the spread of terrorism. It requires financial institutions to obtain more information from an individual or legal entity to help establish identity.

Your cooperation is needed when you open a new account or request a loan. You may be asked more questions to establish and confirm your identity. It may also be required for you to provide one or more forms of identification.
